Doors Open Minneapolis Volunteer Waiver and Release from Liability Agreement
In consideration of being permitted to participate in certain volunteer activities for Rethos’ Doors Open Minneapolis program (Rethos and its Doors Open Minneapolis program referred to herein as “DOM”), I agree as follows:
VOLUNTARY PARTICIPATION: I represent and warrant to DOM that I am at least eighteen (18) years of age and acknowledge that my participation in all DOM activities is voluntary. I agree to abide by all rules established by DOM in connection with my volunteer activities.
ASSUMPTION OF RISK: I acknowledge that certain risks may be involved in volunteering with DOM, including but not limited to risks posed by the physical condition of venues participating or utilized in DOM events, the accessibility of such venues, and interaction with DOM event participants. I agree to fully accept all risk involved in participating as a volunteer for DOM, even those caused by the negligent acts of DOM. I acknowledge this risk and assume full responsibility for any and all risks of injury, illness, death, or damage to or loss of my property. I acknowledge that DOM recommends that I maintain insurance sufficient to cover any such injury, illness, or property damage I may incur while participating in DOM events or activities.
RELEASE OF LIABILITY: I, for myself, my estate, heirs, personal or legal representatives, and assignees hereby do release, waive, discharge, hold harmless from all liability, and promise not to bring any suit or claim against DOM, its affiliates, activity organizers, directors, agents, employees, insurers, or representatives (the “Released Parties”) from any claims, liabilities, losses, or expenses, including reasonable attorney fees, arising from or related to any injury, illness, death, or damage or loss of property resulting from my participation in any DOM event or activity. I agree to indemnify, release, and hold the Released Parties harmless from any liability for any loss, damage, injury or expense that I may suffer arising out of my volunteer activities, even those caused by the negligent acts or omissions of the Released Parties.
LEGAL FEES: If any suit or action shall be commenced by DOM to enforce or interpret this Agreement, the prevailing party shall be entitled to recover from the non-prevailing party all costs and reasonable attorney fees incurred in connection therewith.
PREPARATION: I understand that it is my responsibility to evaluate the difficulties of any DOM activity I participate in and decide whether I am prepared by having the experience, skill, knowledge, equipment, and the physical and emotional stamina to participate safely.
MEDICAL CONDITION: I understand that some DOM venues and spaces are not fully accessible. Venues with limited accessibility may be noted in the HandsOn Twin Cities volunteer postings. I will notify DOM personnel of any medical conditions or physical limitations I have upon signing up as a volunteer for DOM.
MEDIA CONSENT: I authorize DOM to use photographs and video of me and testimonial from me taken during this activity with or without my name for any lawful purpose including publicity, advertising, fundraising, illustration, and web content. I hereby assign any and all rights or interest I may have in such photographs, videos, or testimonials to DOM.
